Purpose

These Terms of Use explain how you may access and use the Meddle Rewards website, merchant dashboard, staff tools, and digital wallet pass services (the Service).

By accessing or using the Service, you agree to these Terms of Use.

Key definitions

  • "Meddle", "we", "us": Meddle Australia PTY LTD (ACN 83 694 964 862).
  • "Service": The Meddle Rewards digital loyalty platform, including websites, applications, digital wallet pass generation, and related services.
  • "You": Any individual or entity who accesses or uses the Service, including Merchants, Staff members, and Customers (reward members).

Eligibility and accounts

  • You must be legally capable of entering into a binding agreement under the laws of Australia.
  • Where you create an account (Merchant or Staff), you must provide accurate information and keep it up to date.
  • You are responsible for keeping your login details secure and for all activity that occurs under your account.
  • You must notify us promptly if you suspect unauthorised access or misuse of your account.

Acceptable use

You must not:

  • attempt to gain unauthorised access to the Service or related systems;
  • interfere with or disrupt the Service, including by introducing malware or overloading systems;
  • use the Service in a way that is fraudulent, misleading, or otherwise unlawful (including the fraudulent issuance of loyalty stamps);
  • attempt to bypass security, rate limits, or access controls.

We may suspend or restrict access where we reasonably believe there is misuse, security risk, or breach of these Terms.

Privacy & Cookies

Our handling of personal information is described in our Privacy Policy. By using the Service, you acknowledge that Meddle processes personal information as described in that policy.

We use cookies and similar technologies to support and improve the Service. By using the Service, you consent to our use of cookies for session management and analytics.

Loyalty Program Responsibility

Meddle provides the platform for digital rewards. The specific rules, rewards, and fulfilment of any loyalty program remain the sole responsibility of the relevant Merchant.

  • Merchants are responsible for ensuring their program rules are clear and compliant with local consumer laws.
  • Meddle is not responsible for any disputes between a Merchant and a Customer regarding stamp balances or reward redemptions.

Intellectual property

  • The Service (including text, software, logos, trademarks, and other content) is owned by or licensed to Meddle and is protected by Australian and international intellectual property laws.
  • You may use the Service and its content only as reasonably necessary to access and use the Service for its intended purpose.
  • Merchants retain rights in their own branding (logos, colours) uploaded to the platform, but grant Meddle a licence to host and display those assets to operate the Service.

Disclaimers

To the extent permitted by law:

  • the Service is provided on an "as is" and "as available" basis;
  • we do not make any guarantee that the Service will be uninterrupted, error‑free, or suitable for every purpose;
  • we exclude all warranties, representations, and conditions that are not expressly set out in these Terms.

IN AUSTRALIA, OUR GOODS AND SERVICES COME WITH GUARANTEES THAT CANNOT BE EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW. Nothing in these Terms limits or excludes any rights, guarantees, or remedies that cannot be excluded under the Australian Consumer Law.

Limitation of liability

To the extent permitted by law:

  • our aggregate liability to you is limited to the greater of: (a) AUD $100; or (b) the fees you have paid to us for the Service in the 3 months immediately before the event;
  • we are not liable for any loss of profit, revenue, goodwill, or data, or for any indirect, incidental, or consequential loss or damage.

Governing law

These Terms of Use are governed by the laws of Australia and, specifically, the laws in force in Western Australia. You submit to the non‑exclusive jurisdiction of the courts of Western Australia.
